  NEW POLICY ON .ng DOMAIN NAME REGISTRATIONS

The Nigerian Internet Registration Association (NIRA) has introduced new policies for .ng domain name registrations.
The new policies take effect from January 2009.Innovations under the new policies.

The requirement for actual business presence in Nigeria prior to domain name registration has been waived. Therefore, Proprietors of trademark registration in Nigeria are now able to apply for domain name registration of the said trademark, whether or not they have business presence in Nigeria. However, the domain name sought to be registered must consist of, or include the exact word component of that registered trademark.

All existing .ng domain names would expire by January 31, 2009. Proprietors of existing domain names are therefore required to renew their registrations on or before February 28 2009, or risk having their domain name purged off the Registry’s Database.

  NIGERIA: FOURTH TRADEMARKS JOURNAL RELEASED

A very welcome development, yet another Trademarks Journal has been published and is now available for sale!

This fourth edition of Trademarks Journal was issued on the last day of the opposition deadline of the third edition (dated 15th October, 2008). It is therefore the fastest issued Journal this year.

In addition to this very welcome feat, the specification of goods for the advertised marks, which had been omitted in previous Journals published this year, has been included in this present publication. The Journal is therefore bulky but has not in anyway diminished in quality!

JEE commends the Nigerian Trademarks Registrar, Hajia Ahmadu- Suka on this impressive achievement and trusts that she will not rest on her laurels in the coming year. The official publication date is: 15th December, 2008, while the statutory two months opposition deadline is 16th February, 2008.

This is because the date of the filing of oppositions will expire on the 15th February 2008. However, this falls on a non working day in Nigeria (Sunday), and the Trademark Regulations stipulate that the next working day would be the applicable deadline, where a deadline falls on a non working day.

JEE carries out Watch Service of the Journal and advises our Clients of the marks that have been published, as well as potential conflict marks they may be interested in opposing.

OAPI PUBLICATION OF “BOPI” (OFFICIAL INTELLECTUAL PROPERTY BULLETIN)

We are pleased to inform you that, the African Intellectual Property Organization (OAPI) has recently published another edition of the quarterly official bulletin of Intellectual Property “BOPI” No. 2/2008 dated 20th November 2008.

Under the OAPI Law, any interested party can oppose the registration of a trademark within a maximum period of six months, from the date of publication. Therefore, the deadline for filing a Notice of Opposition is on 20th May 2009. Note that after the expiration of the statutory period of six months, the registration certification becomes final.

PUBLICATION OF GHANA NEW TRADEMARK JOURNAL

The Ghanaian Trademarks Office has recently published a new Trademark Journal/Gazette No. 8, Volume 3, dated 27th November 2008. The Ghanaian Trademarks Law provides for a two-month opposition period within which all oppositions must be filed. The deadline for compliance is therefore 26th February 2009
